As a way of guaranteeing the maintenance of business activity and, consequently, jobs, an injunction was granted in the state of São Paulo, in the form of a writ of mandamus, assuring the company that the deadline for paying federal taxes would be extended.
In his ruling, the judge considered that the current scenario goes beyond the purely tax-related sphere, to the point where it also begins to involve the fields of public and constitutional law. He stated that the state is responsible for maintaining jobs, the survival of companies and the well-being of citizens.
In order to maintain around 1,500 jobs, the company was obliged to submit a monthly statement of the number of employees dismissed without just cause in the previous month, which was the condition for using the injunction.
This injunction extended the deadline for paying federal taxes by three (3) months from each due date. No charges or monetary restatement will be levied, as long as they are paid within the new deadline.
In addition, the extension granted also covers the filing of the respective returns.
It is therefore important to analyze the needs of each company in order to verify the possibility of requesting an extension to the deadline for payment of federal taxes.
