On February 4, 2021, five Public Notices prepared by the National Data Protection Authority (ANPD) were published in the Federal Official Gazette, for the formation and coordination of the National Council for the Protection of Personal Data and Privacy (CNPD), with members from society, public and private entities.
The CNPD is an advisory body created by the ANPD, which will be made up of twenty-three members of society and public authorities appointed by the President of the Republic, with a two-year mandate.
The body’s main duties are to propose strategic guidelines and provide input for the drafting and monitoring of the National Policy for the Protection of Personal Data and Privacy, as well as assisting the ANPD’s work, drafting studies, debates and public hearings on the protection of personal data and privacy.
The notices allow public and private entities to nominate representatives to the ANPD’s Board of Directors. Each entity will nominate a single name and, based on the nominations, the Board of Directors will draw up a list of three nominations per vacancy, so that the President of the Republic can select a member and alternate member for each vacancy.
It is hoped that the Council, as well as the appointment of qualified professionals for its good management, will contribute to the dissemination of knowledge about the protection of personal data and privacy to the Brazilian population.
