On November 5, Marcos Martins Advogados held the webinar “LGPD: The effects in the current context”. During the virtual meeting, the impact of the General Data Protection Law on civil proceedings and arbitration, tax law and labor relations was discussed. The event was attended by leaders and experts from the firm, who warned of the law’s repercussions in the corporate, civil, tax and labor areas of organizations.
Principles for compliance
The event was mediated by Gabriela de Ávila Machado, a leading lawyer in the corporate area, who specializes in the LGPD and is certified as a DPO (Data Protection Officer). The professionals contributed with debates and discussions in their respective areas in order to present the perspectives and solutions for companies to adapt to the new requirements of the law with regard to data privacy and security.
“The event served to show the practical effects that the law could have on companies’ various activities. We gave some concrete examples of how they can start the process of adapting – of course, always within their limits and possibilities. We have a lot to do, but it’s important to see this whole process as a way of improving the company’s image in the eyes of data subjects and the market itself, as well as reducing the risks of exposure,” says Gabriela Machado.
Among the topics covered were the effects of the LGPD on Arbitration, the confidentiality and secrecy of information in litigation, the impacts of the law on the Covid-19 pandemic and the corporate market. In relation to the tax area, which dealt with the subject in a practical way, the talk was aimed at the Controller, external accounting and the financial sector, showing implications in relation to taxpayers’ data in some respects.
Finally, the topic “LGPD and labor relations” demonstrated the importance of mapping the law within the company, as well as the role of the Data Owner and Controller/Operator, who must make the necessary decisions about the treatment of information.
Interaction with the public
The firm’s leaders closed the webinar by talking about cases, answering questions sent in by subscribers and the challenges of the new developments of the law in force, highlighting the firm’s areas of expertise. With the participation of the audience, the challenges of implementing the law in relation to labor standards were discussed, bringing reflections to the pre-contractual, contractual and post-contractual phases.
Among other questions sent in by the audience, the most important were those related to tax foreclosures and the impact of the LGPD on the tax authorities’ search for satisfaction of tax debts, especially in relation to the mechanisms for searching for assets and values, such as BacenJud, Renajud and the like, which are carried out using taxpayer data.
Another discussion focused on how companies are understanding the need to adapt to the law and the cultural barrier that must be overcome in order to do so.
