On February 1, 2021, Administrative Resolution no. 46/2021 was published, which provides for Expedited Arbitration administered by the Arbitration and Mediation Center of the Brazil-Canada Chamber of Commerce (“CAM-CCBC”) and aims to offer a faster procedure for resolving disputes by arbitration.

In order for a dispute to be submitted to Expedited Arbitration, the amount in dispute must not exceed R$3,000,000.00 (three million reais) and the arbitration agreement must have been agreed after the date of entry into force of the Expedited Arbitration Rules.

In addition, the procedure, unless agreed by the parties, will be conducted and judged by a Sole Arbitrator and should not exceed a period of 10 (ten) months from the signing of the Arbitration Agreement until the start of the period for the delivery of the final award.

The new modality promises to bring conflict resolution in a fast, efficient and safe manner, with significant cost savings and fully electronic. For our clients who are interested in using this new method in their contracts and negotiations, our team is ready to answer any questions and help you.
