Dr. Jayme Petra de Mello Neto, the firm’s Legal Coordinator, is co-author of the book “Commercial Law – Bankruptcy and Corporate Recovery: Integrated Study with the Reform Introduced by Law 14.112/2020 – Volume 6”.
The book analyzes the entire reorganization and bankruptcy microsystem, from the perspective of various authors who make up the GIDE (Interdisciplinary Business Law Group), created and coordinated by Professor Haroldo Verçosa.
Dr. Jayme wrote chapter 9, “The Judicial Reorganization Plan”, which was one of the most changed subjects with the reform of the Reorganization and Bankruptcy Law, which took place in 2020.
The chapter is divided into three parts; in the first part, it deals with the legal nature of the Judicial Reorganization Plan, its procedural and material characteristics as a legal transaction. The second part analyzes each of the legal provisions on the subject, with comments on the topics. In the third part of the chapter, Jayme discusses the Reform‘s innovation – the Substitute Judicial Reorganization Plan, which is presented by the creditors following the rejection of the Recovering Company’s proposed plan.
