The General Personal Data Protection Law (LGPD) has been in force since September 2020. However, it will only be on August 1, 2021 that penalties will be applied to those who fail to comply with its rules.
Individuals and companies that fail to comply with the LGPD will be subject to administrative sanctions, such as a warning, publicizing the infringement, deletion of data related to the infringement, suspension and prohibition of data processing.
Simple and daily fines are also provided for, and can range from 2% of turnover to R$50,000,000.00 (fifty million reais).
