Today, August 26, 2020, the Federal Senate put to a vote in its remote plenary session the amendment to Provisional Measure No. 959/2020 approved by the House on August 25. Through a point of order, it was pointed out that the matter had already been considered by the legislative house so, by decision of Davi Alcolumbre, the provision was removed from the text.
As a result, the General Data Protection Law, published in August 2018, will come into force from the presidential sanction, without postponement, throughout the national territory, except in relation to its sanctions, which will only come into force in August/2021.
That doesn’t mean we can wait until then to comply with the law! Note that although there are no administrative sanctions at the moment, there are other ways in which companies can be held liable for leaking personal data, such as civil, consumer and even criminal.
