President sanctions General Data Protection Law

According to the text published in the Federal Official Gazette, on Friday, September 18, 2020, the General Data Protection Law (originally published in August 2018) was sanctioned, except for its sanctions, which will only come into force in August/2021, as determined by Law 14.010/2020.

The presidential sanction was the last requirement to put into practice the vote of the Federal Senate held on August 26, 2020, on the amendment to Provisional Measure No. 959/2020 approved in the Chamber on August 25. Through a point of order, it was pointed out that the matter of postponement had already been considered by the legislative house so that any postponement was removed from the text of the Provisional Measure.

Now in force, the LGPD can be the subject of lawsuits and corporate liability for leaking personal data, in the civil, consumer and even criminal and labor spheres.
