A measure commonly used by the Judiciary to search for and block debtors’ financial assets, the so-called Bacenjud will be replaced by Sisbajud – the Judiciary’s Asset Search System.

Based on an agreement signed by the National Council of Justice – CNJ, the National Treasury Attorney’s Office – PGFN and the Central Bank – BC, there will be a transition from the Bacenjud system to Sisbajud on August 25, 2020, with the Courts having to make the necessary adjustments to continue searching for financial assets in court proceedings.

According to the established schedule, Bacenjud will be inactive as of September 4, when data will be migrated to Sisbajud, and as of September 8 the latter will start operating exclusively.

The Judiciary permanently invests in improving systems to effectively locate assets in bank accounts registered to the debtor’s CPF or CNPJ.

With Sisbajud, we expect a more technologically up-to-date blocking system, which offers more agile responses to searches. The system is also intended to work in a more integrated way with the Electronic Judicial Process (PJe), one of the electronic platforms on which court proceedings are carried out. The fact that proceedings are carried out in physical form does not exclude access to Sisbajud, and it is also structured for courts whose proceedings are not electronic.

In this way, the implementation of Sisbajud allows us to envision that the online seizure of credits will prove to be more rigorous and faster, seeking to give greater effectiveness to convictions, increasing the likelihood of success in blocking any financial assets in debtors’ bank accounts and, consequently, in satisfying creditors.

The Marcos Martins Law Firm reaffirms its commitment to its clients, following up on legal updates with a view to acting strategically and achieving effective results in the cases for which it is responsible.
