The Federal Supreme Court has ruled that the double payment of vacations outside the legal period provided for in article 145 of the CLT is unconstitutional.
Reporting Justice Alexandre de Moraes voted for the unconstitutionality of Precedent 450, as he considered that the separation of judicial and legislative powers was being violated.
Despite the STF’s decision, companies that fail to meet the deadline for vacation pay will still be subject to penalties from the Ministry of Labor and Employment in the event of an inspection.
