Rural workers’ commute: what about hours in itinere after the labor reform?
Hours in itinere, or commuting hours, consist of the company’s obligation to count the time it takes employees to get to work as hours worked, in situations where the employer provides transportation and the workplace is difficult to reach.
With the labor reform, commuting hours were completely excluded. However, recently, the TRT of the 15th Region ruled that hours in itinere are still due for places that are difficult to access, such as most rural properties.
Other decisions in various Regional Labor Courts maintain this obligation, even after the reform. This highlights the legal uncertainty and the importance of strategic action on the part of companies.
